Will “Reserve+” Be Verified in Europe? What Ukrainians Need to Know About the New Rules for Refugees in the EU

Europe is introducing new checks for Ukrainian refugees when they apply for temporary protection. Who exactly will be affected by these restrictions, and is there a risk that those who have been in the EU for a long time could have their status revoked? The European Union has agreed to extend temporary protection for Ukrainians until March 4, 2028, but with one important condition. Now, when applying for asylum, some citizens will have to prove that they left the country legally and did not violate mobilization rules. This is the most common question, and the answer is unequivocal: no. The new strict rules do not apply at all to people who are already in the EU and have obtained temporary protection status.

If you are already residing in Germany under Paragraph 24, have received a PESEL UKR in Poland, or are under protection in any other European country, no one will revoke your status. Your documents will be extended through 2028 according to the standard procedures of your country of residence, and you will not have to prove the legality of your departure from Ukraine again.

Additional checks will apply only to “new applicants.” This refers to people who leave Ukraine and apply for asylum in Europe for the first time after the new EU decision officially takes effect.

It is these individuals whom immigration authorities will question about how they crossed the border. If a person is subject to military service but cannot confirm that Ukrainian border guards allowed them to leave legally, they may be denied temporary protection.

European legislation does not distinguish between refugees based on gender or age. The document contains no mention whatsoever that refugee status will no longer be granted to adult men. The main requirement is compliance with the laws of one’s home country at the time of departure.

If a man of draft age crossed the border legally (for example, due to health issues, a disability, to care for a relative, or for other family circumstances), he has every right to receive protection in the EU. Incidentally, the same rule applies to women subject to military service.

Official EU documents do not mention the “Reserve+” app as mandatory at all. For now, the main proof that you have not violated any laws remains a standard Ukrainian passport with a stamp confirming legal border crossing.

However, local immigration inspectors may request additional documents to determine the basis on which you were allowed to leave the country. In such a situation, an electronic document from “Reserve+” (especially if it indicates a valid deferment) will serve as a strong argument. But it is still too early to call this app the sole ticket to Europe.

It is important not to confuse EU immigration services with Ukrainian consulates. While a paper or electronic military ID is currently required to obtain a new passport at a Ukrainian consulate abroad, European officials simply want to ensure that you did not flee the country illegally.

The extension of the protection program itself will be in effect from spring 2027 to spring 2028. However, the new rules for document checks at the border will take effect earlier. They will come into force the day after the decision is published in the Official Journal of the EU. Each European country will determine the final details and the exact list of required documents separately at a later date.
